    Title 1. Ch. 1.01, Section 1.08.030 provides that the responsible department shall be the city department, its Director or Deputy Director, or other person so designated either by the City Manager or code or ordinance as responsible for enforcement of the provisions of the codes and ordinances identified in this chapter.

    Oakland Municipal Code Ch. 18, sec 08.18.010, Section D.1. provides that a “written or verbal warning shall be issued by the investigating official or his or her agent to the person(s) responsible for the event causing the noise disturbance.” Section E.1. further provides for administrative citations in addition to other remedies.

    Accordingly, please route this complaint to the responsible department and/or responsible person for investigation, assessment, citation, and abatement.

    There are approx twelve tents in the middle of the park, where children play, where people walk, etc. The encampment is also directly adjacent to Montclair Elementary School. Homeless are defecating etc and this is a public hygiene challenge for pedestrians who have a right to use the park as it is designed to be used. The park is not designed to be used for people to live on it. It is the city's responsibility to find housing for these people so that the park may be used as a park.
